These Terms of Service ("Terms") govern your access to and use of VakilAI Pro ("Service"), operated by Barkat AI Automation ("we", "us", "our"), based in Ranchi, Jharkhand, India. By creating an account or using the Service, you agree to these Terms.
1. The Service
VakilAI Pro is an AI-assisted legal drafting and case-tracking workspace for legal professionals in India. It provides document templates, AI-generated draft text, case status lookup via CNR numbers, and related productivity tools.
2. Not Legal Advice
The Service is a drafting and research assistance tool. It does not provide legal advice, does not create an advocate-client relationship with us, and is not a substitute for the professional judgment of a qualified advocate. You are solely responsible for reviewing, verifying, and finalising any document before use, filing, or service. AI-generated content may contain errors or outdated references; verification against the bare acts and current law is your professional responsibility.
3. Eligibility & Accounts
- You must be at least 18 years of age and legally competent to contract under Indian law.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- Chamber/team plans: the account owner is responsible for the actions of all invited users.
4. Subscriptions, Billing & Taxes
- Plans are billed in Indian Rupees (INR) via Razorpay on a recurring monthly or annual basis, as selected at checkout.
- Prices are exclusive of applicable GST unless stated otherwise; a GST invoice is issued for every payment.
- You may cancel at any time from your account settings; access continues until the end of the current billing period. Refunds are governed by our Refund & Cancellation Policy.
- We may revise pricing with at least 15 days' prior notice; revised prices apply from your next billing cycle.
5. Acceptable Use
You agree not to:
- use the Service for any unlawful purpose or to draft documents intended to facilitate fraud, harassment, or any offence;
- attempt to reverse-engineer, scrape, resell, or provide unauthorised third-party access to the Service;
- upload content that infringes any third party's rights or contains malware;
- circumvent usage limits of your plan.
We may suspend or terminate accounts that violate these Terms, with notice where reasonably practicable.
6. Your Content & Data
You retain all rights to the case facts, documents, and information you input ("Your Content"). You grant us a limited licence to process Your Content solely to provide the Service. We do not sell Your Content and do not use it to train AI models. Handling of personal data is described in our Privacy Policy, in accordance with the Digital Personal Data Protection Act, 2023.
7. Intellectual Property
The Service, including its software, templates, design, and branding, is owned by Barkat AI Automation. Drafts generated for you may be used freely in your professional practice. You may not reproduce or redistribute our template library outside the Service.
8. Third-Party Services
Case status data is retrieved from publicly available sources (such as the eCourts services) and payments are processed by Razorpay. We are not responsible for the accuracy or availability of third-party data or services.
9. Availability & Changes
We aim for high availability but do not guarantee uninterrupted access. We may modify, add, or discontinue features; material reductions in paid functionality will be notified in advance.
10. Limitation of Liability
To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service shall not exceed the amount paid by you to us in the three (3) months preceding the claim. We are not liable for indirect, incidental, or consequential losses, including loss of profits, loss of a case, missed limitation periods, or professional consequences arising from reliance on AI-generated content without independent verification.
11. Indemnity
You agree to indemnify us against claims arising from your breach of these Terms or your use of drafts without appropriate professional review.
12. Termination
You may stop using the Service and cancel at any time. On termination, you may export your drafts for 30 days, after which data may be deleted in accordance with our Privacy Policy.
13. Governing Law & Jurisdiction
These Terms are governed by the laws of India. Subject to any mandatory law, the courts at Ranchi, Jharkhand shall have exclusive jurisdiction over disputes arising from these Terms or the Service.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified by email or in-app notice at least 7 days before taking effect. Continued use after the effective date constitutes acceptance.
